When Library Systems & Services (LSSI) took over operations of the Jackson County Library System (all 15 libraries), employees lost their right to union representation. The Successorship Doctrine provides an avenue for library employees to keep their union and to bargain for wages, benefits and working conditions.

BREAKING NEWS: "LSSI has to recognize union for its employees" says Buck Eickler, President, JCEA/SEIU #503 (JCEA is the Jackson County Employees Association)
There is a Federal Labor Law called the “successorship doctrine.” Basically, it holds that when a union represented concern closes and reopens as non-union, and if they are doing the same kind of work and re-hire 50%+1 of the old employees back, the union is recognized. SEIU has filed a demand for recognition with LSSI, and after analyzing the situation with their lawyers LSSI responded and said, "no" A ULP (unfair labor practice) has been filed by the union.
This “successorship doctrine" law was upheld by the National Labor Relations Board (NLRB) in the Fall of 2006, and it was a similar circumstance, a case with public employee school bus drivers, whose operation was privatized

¨ SEIU is pleased to announce that Federal law (Successorship) entitles LSSI employees to continue union representation.
¨ This does not require library employees to conduct a membership campaign or hold an election. It is a simple legal procedure that SEIU has filed.
¨ Jackson County Library workers may have their own SEIU local consisting only of LSSI employees. They will have the resources of SEIU to assist with fund raising, levy campaigns, etc. to increase and stabilize library funding.
¨ LSSI union employees will bargain their own contract with LSSI, and will still be private, not public employees. As private employees, these workers will not be able reactivate PERS accounts, but private retirement accounts will be subject to bargaining.
¨ Library workers' contract proposals will reflect the priorities of their membership. All members will have the opportunity to provide input into contract proposals.
¨ This need not create burdensome costs for LSSI, but will provide gains for employees. For instance, in such a partnership with LSSI, workers can cooperatively schedule increases in employee hours (with increased library hours) and employee compensation tied to increased library revenues.
This is an exciting opportunity for LSSI employees to work toward improving wages, benefits and working conditions, as well as for LSSI to work in partnership toward mutual goals to build the library system back up to the venerable institution it was intended to be.

The story is certainly real, except I am not certain the ULP has been filed already, but it will be. The case will first be heard at the NLRB office in Seattle. The case I cited was out of Grand Rapids Michigan, the bus company taking over operations was Dean Transportation, and the info.
